Welcome to FetchMeNow (“we,” “us,” “our”). These Terms and Conditions (“Terms”) govern your access to and use of the FetchMeNow mobile application, website, and related services (collectively, the “Services”).
By creating an account or using our Services, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use FetchMeNow.
FetchMeNow provides a technology platform that connects users who seek transportation or delivery services (“Riders” or “Customers”) with independent third-party contractors (“Drivers” or “Delivery Partners”).
FetchMeNow is not a transportation or delivery company—we do not provide the actual rides or deliveries. Drivers are independent contractors, not employees, agents, or representatives of FetchMeNow.
To use FetchMeNow:
You must be at least 18 years old (or the age of majority in your state).
You must have legal authority to enter into a binding contract.
You agree to comply with all applicable federal, state, and local laws.
Drivers must pass identity and background checks as required by law and FetchMeNow’s internal standards.
To use the app, you must register for a FetchMeNow account and provide accurate and complete information.
You are responsible for:
Maintaining the confidentiality of your login credentials.
All activity under your account.
You must notify us immediately at [support@fetchmenow.net] if you suspect unauthorized access to your account.
You agree to:
Use the Services only for lawful purposes.
Not damage, interfere with, or disrupt the app or its networks.
Not use the Services to harm, threaten, or harass anyone.
We reserve the right to suspend or terminate accounts that violate these Terms.
When you book a ride or delivery, you agree to pay the displayed fare, taxes, and applicable fees through the app. All payments are processed through secure third-party payment processors.
Drivers are paid per completed trip/delivery, after FetchMeNow’s service fee is deducted. Payment schedules and methods are governed by the Driver Agreement.
Refund Policy:
All rides and deliveries are final once completed. Refunds may be issued at our sole discretion for service disruptions, cancellations, or safety-related issues.
Riders may cancel rides before a driver is assigned at no charge.
Cancellation after driver assignment may result in a cancellation fee.
Drivers may not cancel repeatedly without cause, or their account may be suspended.
Users may rate each other after each trip. Ratings help maintain service quality.
You agree that:
Your feedback must be honest and respectful.
FetchMeNow may remove abusive or fraudulent reviews.
We may use ratings to evaluate account standing and performance.
You may submit text, photos, or other content through the app (“User Content”). By submitting, you grant FetchMeNow a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your content for service improvement and promotional purposes.
You are solely responsible for your content and must ensure it does not violate others’ rights or applicable laws.
Safety is our top priority.
Drivers and Riders must:
Follow all traffic laws.
Wear seatbelts and avoid distractions.
Treat others with respect.
FetchMeNow may suspend or terminate any account for safety violations, harassment, or misconduct.
Drivers must carry valid automobile insurance as required by state law.
FetchMeNow maintains contingent insurance coverage during active trips as required by applicable regulations, but we are not liable for any personal or property damage caused during a trip except as required by law.
FetchMeNow provides a platform; we do not control or guarantee the quality, timing, or safety of rides or deliveries.
The Services are provided “as is” and “as available”, without warranties of any kind, express or implied.
We do not guarantee that the app will be error-free or uninterrupted.
To the maximum extent permitted by law:
FetchMeNow shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
Our total liability arising from or related to the Services shall not exceed the total amount paid by you for the Services in the three (3) months preceding the claim.
You agree to indemnify and hold harmless FetchMeNow, its officers, employees, and affiliates from and against all claims, damages, losses, and expenses arising from:
Your use of the Services.
Violation of these Terms.
Violation of any rights of another person or entity.
We may suspend or terminate your access to the Services:
For violation of these Terms.
For illegal or unsafe conduct.
Or at our discretion, with or without notice.
You may delete your account anytime through the app or by contacting [support@fetchmenow.net].
Any dispute between you and FetchMeNow will be resolved through binding arbitration, rather than in court, except for small claims or injunctive relief.
You waive the right to a jury trial and to participate in class actions.
Arbitration will be conducted under the rules of the American Arbitration Association (AAA) in the state where you reside.
These Terms are governed by and construed under the laws of the State of [Your State, e.g., California], without regard to its conflict of laws principles.
We may modify these Terms at any time. Updated Terms will be posted in the app and on our website with a new “Effective Date.” Continued use of FetchMeNow after updates means you accept the revised Terms.
